The public information on U.S. Supreme Court Chief Justice Nominee, Judge John Roberts raises serious concerns for the environment, civil rights, workers rights, privacy and women’s health. The NC Conservation Network is part of a large, statewide coalition to "Just Ask for Justice": a grassroots campaign to ensure a fair and thorough review of Judge Roberts's nomination by the US Senate. The stakes for the environment are high and North Carolinians deserve to know where John Roberts stands on these issues.
Please email Senator Dole and Senator Burr today and urge them to ask the Senate Judiciary Committee to find out where Judge Roberts stands on the environment by asking one of the following questions:
- Does John Roberts believe Congress has the constitutional authority under the Commerce Clause to protect lakes, waterways, or endangered species that do not cross state lines?
(Why ask this? The Commerce Clause is the foundation for many of our environmental laws. In a dissenting opinion in a recent environmental case, Judge Roberts wrote that the reach of the Commerce Clause had not been adequately addressed).
- Does John Roberts believe the Clean Air Act requires EPA to adopt the most protective standards achievable to safeguard the public from known toxins and carcinogens?
(Why ask this? The Clean Air Act requires polluters to protect human health, without exceptions for cost. In recent years, industry lawyers have tried to force EPA to include cost as a factor even where the Clean Air Act does not).
- Does John Roberts believe all Americans have the right to go to court to protect their health and the environment around them?
(Why ask this? In recent years, right-wing judges have sought to limit 'standing', or the right of citizens to seek judicial review to protect themselves, their communities, and the environment. Even when laws are strong, there's no way to ensure they are implemented when we can't get into court).
